General Terms and Conditions – Elscooters.se

These general terms and conditions apply when you, as a customer, purchase products from Elscooters.se via the website elscooters.se or any other sales channel used by Elscooters.se.

By completing a purchase, you agree to these terms.

1. Definitions

In these terms, the following definitions apply:

"We", "us", "our" or "the Seller": Elscooters.se. "Customer": the person or company making a purchase. "Consumer": a natural person who primarily acts for purposes outside of a business activity. "Business Customer": a legal entity or natural person acting for a business activity. "Website": elscooters.se. "Products": the goods sold by Elscooters.se.


2. Order and Agreement

An order constitutes an offer by the Customer to purchase the products specified in the order.

A binding agreement is formed when Elscooters.se has confirmed the order through an order confirmation sent to the email address provided by the Customer.

The Customer is responsible for ensuring that the information provided during the order is correct, complete, and current. This includes, for example, name, address, phone number, email address, and delivery information.

Elscooters.se reserves the right to refuse or cancel an order in cases of, for example, incorrect information, suspected fraud, technical errors, obvious pricing errors, incorrect stock status, or other circumstances that prevent the order from being fulfilled.


3. Products and Product Information

We strive to describe our products as accurately as possible. However, product images, colors, measurements, and specifications may vary slightly depending on monitor, lighting conditions, production variations, or manufacturer updates.

For electric scooters, electric bikes, and similar products, technical specifications, range, speed, weight, power, battery capacity, and other information may vary depending on factors such as riding style, load, temperature, terrain, tire pressure, battery condition, and other external conditions.

The Customer is responsible for verifying that the product is suitable for its intended use before purchase.

For products subject to specific traffic regulations, the Customer is responsible for complying with applicable laws and regulations regarding use, insurance, helmet use, age requirements, and traffic environment.

We reserve the right for typographical errors, technical errors, incorrect product information, incorrect prices, stock errors, and out-of-stock items.


4. Prices and Payment

All prices are stated in Swedish kronor including VAT, unless explicitly stated otherwise.

Shipping costs and any additional charges are displayed at checkout before the purchase is finalized.

Prices, campaigns, and discounts may change without prior notice. The price applicable to the Customer is the price stated at the time of ordering and as shown in the order confirmation, with reservation for obvious errors.


5. Delivery

Delivery takes place to the address provided by the Customer when placing the order.

Delivery time varies depending on the product, stock status, and carrier. Estimated delivery time is usually stated at the time of order or in the order confirmation.

The Customer is responsible for providing a correct delivery address and contact information and for being available to receive the delivery.

If delivery cannot be completed due to circumstances attributable to the Customer, such as an incorrect address or failure to receive the delivery, the Customer may be charged for return shipping costs or a new delivery attempt.


6. Transfer of Risk

For consumers, the risk of the goods passes to the Customer when the Customer has received the goods.

For business customers, the risk normally passes when the goods have been handed over to the carrier for delivery, unless otherwise agreed.


7. Right of Withdrawal for Consumers

Consumers have a legal right to withdraw from their purchase within 14 days from the day the Customer received the goods.

To exercise the right of withdrawal, the Customer must notify Elscooters.se within the withdrawal period via: elscooters.se@gmail.com

The notification must clearly state that the Customer wishes to withdraw from the purchase and include the order number, name, and the product to which the return applies.

The Customer must then return the product within 14 days from the notification. The Customer is responsible for return shipping costs for a cancelled purchase.

The product must be returned well packaged. The Customer is responsible for the product during return transport and should use traceable shipping.

If the product has been handled more than necessary and this has led to a reduction in value, Elscooters.se has the right to deduct the depreciation from the refund.


8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to products that have been manufactured according to the Customer's instructions or that have otherwise been given a clear personal character, such as custom-made or specially adapted products.


9. Refund upon Withdrawal

Upon an approved return, Elscooters.se will refund the amount using the same payment method the Customer used for the purchase, unless otherwise agreed.

We may withhold the refund until we have received the goods or until the Customer has demonstrated that the goods have been returned.

Standard shipping is refunded. Extra costs for more expensive delivery options are not refunded. Return shipping costs are borne by the Customer.


10. Complaints

Consumers have the right to complain about defects in goods in accordance with the Consumer Sales Act (2022:260). The right to complain is valid for 3 years from receipt. The Customer must complain within a reasonable time after the defect has been discovered. A complaint within 2 months of the defect being discovered is always considered to be within a reasonable time.

The Customer should provide the order number, name, description of the defect, and preferably attach pictures or video.

In the case of an approved complaint, Elscooters.se has the right to primarily remedy the defect through repair or redelivery.

The right to complain does not apply to defects caused by normal wear and tear, improper use, lack of maintenance, accident, moisture damage outside the product's specified resistance, modification, or tuning.

The Customer should not return a complained product without first contacting us and receiving instructions.


11. Warranty

Unless otherwise stated, a 12-month warranty is provided on the motor and battery.

The warranty applies in addition to the Customer's statutory rights and does not cover normal wear and tear, improper use, accident, moisture damage outside the product's specified resistance, modification, or tuning.


12. Business Customers

For business customers, consumer legislation does not apply. For purchases made by business customers, the Sale of Goods Act (1990:931) and these terms apply. Return or cancellation only occurs after special agreement.


13. Personal Data

Elscooters.se processes personal data in accordance with the General Data Protection Regulation (GDPR). More information can be found in our privacy policy.


14. Limitation of Liability

Elscooters.se is not responsible for indirect damages, lost profits, or other indirect losses, except in cases where liability arises from mandatory law. Consumers' rights under mandatory legislation are not affected.


15. Force Majeure

Elscooters.se is not responsible for delays caused by circumstances beyond our reasonable control, such as natural disaster, war, government decision, transport disruption, pandemic, or similar events.


16. Changes to the Terms

Elscooters.se may update these terms. The version applicable to the Customer's purchase is the version that was published at the time of the order.


17. Disputes and Applicable Law

These terms are interpreted in accordance with Swedish law. Disputes shall primarily be resolved through dialogue.

If a dispute with a consumer cannot be resolved, the consumer can turn to the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, www.arn.se.

Disputes with business customers shall be settled by a Swedish public court with Gothenburg District Court as the first instance.
